Negara Hukum Versus Negara Kekuasaan: Studi Filsafat Hukum Terhadap Penegakan Asas Equality Before The Law dalam Kasus Roy Suryo Dan Dr. Tifa

Abstract
Artikel ini mengkaji pertentangan konseptual antara negara hukum (rechtstaat) dan negara kekuasaan (machtstaat) melalui perspektif filsafat hukum, dengan fokus pada penerapan asas equality before the law dalam kasus yang melibatkan Roy Suryo dan dr. Tifa. Kasus ini berangkat dari dugaan pencemaran nama baik terkait isu ijazah Presiden Republik Indonesia, yang menempatkan kedua figur publik tersebut dalam proses hukum yang intens dan menjadi sorotan publik . Penelitian ini menggunakan pendekatan kualitatif dengan metode analisis normatif-filosofis untuk menelaah sejauh mana prinsip persamaan di hadapan hukum benar-benar diimplementasikan tanpa diskriminasi. Hasil kajian menunjukkan bahwa secara normatif, sistem hukum Indonesia telah mengadopsi prinsip equality before the law sebagai bagian dari negara hukum. Namun, dalam praktiknya, dinamika kekuasaan, opini publik, dan konstruksi sosial terhadap figur tertentu berpotensi memengaruhi persepsi dan implementasi keadilan tersebut. Dengan demikian, penelitian ini menegaskan pentingnya menjaga independensi penegakan hukum agar tidak terdistorsi oleh kepentingan kekuasaan, sehingga prinsip negara hukum dapat berjalan secara substansial, bukan sekadar formalitas.
