Bias Algoritma Artificial Intellegence (AI) Dalam Perspektif Maqāṣid Al-Syarī‘Ah

Abstract
Perkembangan Artificial Intelligence (AI) telah mentransformasi berbagai sektor kehidupan, namun juga memunculkan persoalan serius berupa bias algoritma yang berpotensi menghasilkan diskriminasi sistemik. Fenomena ini menghadirkan tantangan normatif dalam perspektif hukum Islam, karena keputusan algoritmik dapat memengaruhi keadilan sosial, distribusi ekonomi, dan otonomi intelektual individu. Penelitian ini bertujuan menganalisis bias algoritma dalam kerangka maqāṣid al-syarī‘ah, khususnya prinsip ʿadl, maṣlaḥah, ḥifẓ al-ʿaql, dan ḥifẓ al-māl. Penelitian menggunakan pendekatan kualitatif dengan desain normatif-empiris. Data diperoleh melalui studi kepustakaan mengenai etika AI dan teori maqāṣid, serta wawancara semi-terstruktur dengan pemangku kepentingan yang terlibat dalam pengembangan dan penggunaan AI. Analisis dilakukan secara tematik untuk mengidentifikasi pola bias dan relevansinya terhadap prinsip syariah. Hasil menunjukkan adanya data bias, design bias, dan deployment bias yang mereproduksi ketidakadilan sosial-ekonomi. Bias tersebut berpotensi bertentangan dengan prinsip keadilan dan kemaslahatan, serta berdampak pada perlindungan akal dan harta. Penelitian ini merumuskan kerangka etika AI berbasis maqāṣid yang menekankan keadilan substantif, transparansi, dan akuntabilitas. Integrasi nilai-nilai syariah dalam tata kelola AI memperkaya pengembangan hukum Islam kontemporer dan memberi implikasi praktis bagi regulator serta pengembang teknologi.
